TERMS OF USE


Welcome to ViaVol. By accessing ViaVol website ("Site") or using the buttons ("Buttons") and the services offered by ViaVol ("Services") you agree and acknowledge to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access the Site or any part of the Site, or use the Services. ViaVol grants you a limited license to access the Site and use the Buttons and Services in accordance with these Terms and the instructions and guidelines posted on the Site. ViaVol reserves the rights to terminate your license to use the Site, the Buttons and the Services at any time and for any reason.

ViaVol reserves the right to change these Terms at any time; please check these Terms periodically to review any changes. Your continued use of this Site following the posting of any changes to the Terms constitutes acceptance of those changes.

USER CONDUCT
You are solely responsible for your use of the Site, the Buttons and the Services. You agree to abide by all applicable local, state, national and international laws, regulations, ordinances, bylaws and rules. You agree to use the Site and Services in an ethical manner. You agree not to, by way of example, and not as a limitation:

  • send chain letters, junk emails and spam;
  • gain or attempt to gain unauthorized access to the Site, the Services, accounts, systems or networks connected to the Site;

  • forge identity to mislead or attempt to mislead others;
  • transmit or post any unlawful, unethical, threatening, harassing, defamatory, pornographic, libelous, invasive of another's privacy or harmful content or any materials that may infringe the intellectual property rights or other rights of third parties, or any materials that harms minors in any way;
  • interfere with another user.

    • INTELLECTUAL PROPERTIES
    ViaVol-originated content included on the Site, such as text, graphics, logos, data compilations, APIs, software and the compilation of all content on the Site, is the property of ViaVol and its licensors. Except as set out in these Terms, no reproduction of any ViaVol-originated content is permitted without written permission from ViaVol.

    CONTENT PROVIDED BY USER
    By posting or submitting content to the Site you automatically grant to ViaVol the right to use, reproduce, display, perform, adapt, modify, distribute or promote the content in any form for any purpose. You further represent and warrant that you own or otherwise control all necessary rights to the content and that public posting and use of the content by ViaVol will not infringe or violate the rights of any third party. You acknowledge and agree that you are responsible for all content posted or submitted by you. ViaVol merely serves as a data repository, content posted by user does not represent the advice, views, opinions, endorsement, affiliation or beliefs of ViaVol, and ViaVol makes no claim of accuracy of any user-posted material or any content connected to the user-posted material.

    NOTIFICATION OF CLAIMS OF INFRINGEMENT
    If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify ViaVol's agent for notice of claims of copyright or other intellectual property infringement ("Agent") . Please provide our Agent with the following Notice:

  • Identify the copyrighted work or other intellectual property that you claim has been infringed;
  • Identify the material on the Site that you claim is infringing, with enough detail so that we may locate it on the website;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner;
  • Your address, telephone number, and email address; and
  • Your physical or electronic signature.

    • ViaVol will remove the infringing posting(s), subject to the the procedures outlined in the Digital Millennium Copyright Act (DMCA).

    TERMINATION
    ViaVol may, without notice, terminate, suspend, disconnect, deny or restrict your access to the Site and Services.
    ViaVol may, without notice, discard or delete any data within the Site, including any user account or any content posted by user.

    NO WARRANTY AND LIMITATION OF LIABILITY
    VIAVOL PROVIDES THE SITE, BUTTONS AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. VIAVOL SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT.

    You understand and agree that you use the Site, Buttons and Services at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. UNDER NO CIRCUMSTANCES SHALL VIAVOL BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR SERVICES, DAMAGES INCURRED THROUGH ANY LINKS PROVIDED ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT VIAVOL HAS BEEN ADVISED OF SUCH POSSIBILITY. YOUR ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH THIS SITE OR SERVICES OR WITH VIAVOL SHALL BE TO TERMINATE USE OF THIS SITE AND SERVICES.
